When the time comes to part company, Settlement Agreements can assist in providing a smooth pathway to an exit from the business on agreed terms. It is always wise to explore proposals for settlement before any more complex steps are taken e.g. employment tribunal proceedings.
We have advised on over a thousand settlement agreements (formerly compromise agreements) and know our way around these types of agreement.
Usually, the employer will contribute a fixed sum towards the employee’s costs for independent legal advice as to the nature and effect of the terms in the settlement agreement. This sum usually covers the costs for providing the advice and so the employee will not have to pay anything in the vast majority of cases. The standard contribution is normally £350 + vat for a straight-forward, regular agreement.
